Professional Liability Insurance — at a glance

If a client claims your professional service caused them a loss, financial or otherwise, the defence alone can be crushing. Professional liability insurance (also called errors & omissions) covers the legal costs and settlements that arise from a real or alleged mistake in your work.

What Professional Liability Insurance protects.

Standard Ontario professional liability insurance policies include most of the coverages below by default. We add the endorsements and limits specific to your property, vehicle, or operation, and re-shop the policy at every renewal so your premium tracks the market, not the insurer's loyalty habit.

Defence costs

Lawyer fees and court costs, often outside your limit.

Settlements & judgments

Amounts you're legally required to pay after a claim.

Prior acts

Coverage for work done before the policy started, when arranged.

Disciplinary defence

Costs of responding to a regulatory complaint.

Subcontractor coverage

Protection when the work of your subconsultants is challenged.

Professional Liability Insurance FAQ

Professional Liability Insurance questions, answered.

What's the difference between general liability and E&O?+

General liability covers bodily injury and property damage. E&O covers financial loss from a real or alleged mistake in your professional service. Most professional businesses need both.

What are prior acts and do I need them?+

Prior-acts coverage protects you for work performed before your current policy started. Without it, a claim today about a project from two years ago may not be covered. We arrange prior-acts coverage whenever possible.

How much E&O should a consultant carry?+

Limits depend on your contract terms and client expectations, $1M to $5M is common. We match your limits to the engagements you actually sign so you meet client requirements without overpaying.

What's the difference between claims-made and occurrence policies?+

Most E&O is claims-made, meaning it responds to claims reported during the policy period, not when the work was done. We explain the difference and arrange the reporting and tail coverage that continuity requires.

Do I still need E&O if my contract caps my liability?+

A liability cap limits what you owe a client, but it doesn't stop the claim, the defence cost, or a claim from a non-contracting party. We recommend E&O even with contractual limits because the defence alone can be costly.

What is tail coverage and when do I need it?+

Tail (extended reporting) coverage lets you report claims after a claims-made policy ends, for work done during it. We arrange tail when you change carriers or wind down a practice so prior work stays protected.

Does E&O cover work performed by my subcontractors?+

It can, with the right sub-consultant coverage extension. We add it so a subcontractor's alleged error is covered under your policy rather than leaving you to chase their cover.

How do I switch E&O insurers without a coverage gap?+

We coordinate the retroactive date on the new policy with the expiry of the old so prior acts stay covered seamlessly. A misaligned switch can leave years of work uninsured, which we prevent.

Does E&O defend a frivolous claim, or only ones I was at fault for?+

E&O defends claims that are alleged, not just proven, so a baseless complaint still triggers defence coverage up to your limit. That matters because the legal cost of defending a false claim can rival a real one.
